This Privacy Policy describes how BrokerBotics.ai ("BrokerBotics") collects, uses, discloses, retains and protects personal information in connection with the website located at brokerbotics.ai and its subdomains, including any sign-up form, application form, survey or email communication made available through it, and the Ask the Manager application located at chat.brokerbotics.ai (collectively, the "Services"). BrokerBotics is responsible for personal information under its control and has designated a Privacy Officer who is accountable for its compliance with this Privacy Policy and with the Personal Information Protection and Electronic Documents Act (Canada) ("PIPEDA"). The Privacy Officer may be contacted at david@brokerbotics.ai. The Services are operated by BrokerBotics independently and are not provided by or on behalf of any real estate brokerage, regulator or industry association. By using the Services or submitting personal information to BrokerBotics, you acknowledge that you have read and understood this Privacy Policy and consent to the collection, use and disclosure of your personal information as described herein.

2. Personal Information Collected

BrokerBotics collects personal information that you provide directly, which may include, depending on the Service used: your email address; your first and last name; the name of your brokerage; your years in the real estate business; the approximate number of transactions you complete each year; your responses to confirmation statements, including confirmation of your registration status in Ontario, your agreement to participate in a survey and your consent to receive electronic messages; your Ask the Manager username; the questions you submit to Ask the Manager, the answers generated in response and the date and time of each question; your responses to surveys; and the content of any correspondence you send to BrokerBotics. BrokerBotics also collects certain information automatically, including whether you open emails sent by BrokerBotics and which links you click within them, the source or campaign through which you reached a page, and technical information recorded by BrokerBotics's service providers in the ordinary course of operating their services, such as IP address, browser type, device information and the date and time of a request. Certain pages of the website use the Meta Pixel, a technology provided by Meta that records page visits and form submissions and may use cookies or similar technologies; information collected through the Meta Pixel is processed by Meta in accordance with its own data policy and may be associated by Meta with your Meta account. You must not submit personal information about any other person, including any client or prospective client, to Ask the Manager. BrokerBotics does not request such information, and any such information submitted in breach of this Privacy Policy or the Ask the Manager Terms of Use will be treated in accordance with this Privacy Policy but may not be removed from the question log until it is identified.

3. Purposes of Collection and Use

BrokerBotics collects and uses personal information for the following purposes: to provide the content, communications and Services you request, including periodic market updates; to receive, assess and select applications for the Ask the Manager trial and to issue, administer and terminate trial access; to operate Ask the Manager, including enforcing daily usage limits and access periods; to review questions and answers for the purpose of identifying inaccurate answers and improving the accuracy, coverage and performance of Ask the Manager; to send electronic messages regarding Ask the Manager, Agent Protocol and the use of artificial intelligence in real estate where you have provided express consent; to administer surveys and analyze feedback; to measure and improve the effectiveness of the website and of BrokerBotics's advertising; to maintain records of consent and withdrawal of consent as required by Canada's Anti-Spam Legislation ("CASL"); to protect the security and integrity of the Services; and to comply with applicable law. BrokerBotics will not use personal information for any purpose other than those identified in this Privacy Policy without first identifying the new purpose and obtaining your consent, unless permitted or required by law.

4. Consent and Electronic Messages

BrokerBotics obtains your express consent before sending commercial electronic messages and confirms that consent by means of a confirmation email requiring you to verify your email address. Each commercial electronic message sent by BrokerBotics identifies the sender, includes a valid mailing address and contains an unsubscribe mechanism that may be used to withdraw consent at any time. You may withdraw your consent to the collection, use or disclosure of your personal information at any time, subject to legal or contractual restrictions and reasonable notice, by unsubscribing or by contacting the Privacy Officer. Withdrawal of consent may prevent BrokerBotics from providing certain Services to you, including the issuance of Ask the Manager trial access and related communications.

5. Disclosure to Service Providers

BrokerBotics does not sell, rent or trade personal information. BrokerBotics discloses personal information only to service providers that perform services on its behalf, and only to the extent necessary for them to perform those services, including: Brevo, which provides sign-up forms, contact management and email delivery and processes data in the European Union; Render, which hosts the website and Ask the Manager in the United States; Anthropic, which provides the artificial intelligence model that generates Ask the Manager answers and to which the questions you submit are transmitted for that purpose, in the United States; Cloudflare, which stores the Ask the Manager question log and usage counts in the United States and other jurisdictions; Meta, which provides the Meta Pixel for advertising measurement; and Google, which serves web fonts used on the website. These service providers are located outside Canada, and personal information processed by them may be stored and accessed in jurisdictions outside Canada, where it may be subject to disclosure to courts, law enforcement and other authorities in accordance with the laws of those jurisdictions. BrokerBotics may also disclose personal information where required or permitted by law, including in response to a lawful request by a public authority, or in connection with the sale, transfer or reorganization of all or part of its business, provided that the recipient agrees to protect the information in a manner consistent with this Privacy Policy.

6. Retention

BrokerBotics retains personal information only for as long as necessary to fulfil the purposes identified in this Privacy Policy or as required by law. Contact information collected through sign-up forms is retained until you withdraw consent or request deletion, except that records of consent and withdrawal of consent are retained as required by CASL. Ask the Manager trial applications, question and answer logs and survey responses are retained for up to twenty-four (24) months following the end of the applicable trial period, after which they are deleted or anonymized, except that BrokerBotics may retain aggregated or anonymized information that no longer identifies you for an indefinite period.

7. Safeguards

BrokerBotics uses physical, organizational and technological safeguards appropriate to the sensitivity of the personal information it holds, including restricted access to accounts, password protection, individual user credentials for Ask the Manager and encryption of data in transit. No method of transmission or storage is completely secure, and BrokerBotics cannot guarantee the absolute security of personal information. Where a breach of security safeguards involving personal information under its control creates a real risk of significant harm to an individual, BrokerBotics will notify the affected individuals and the Office of the Privacy Commissioner of Canada and will maintain records of such breaches as required by PIPEDA.

8. Access, Correction and Deletion

Subject to applicable law, you may request access to the personal information BrokerBotics holds about you, request the correction of personal information that is inaccurate or incomplete, and request the deletion of your personal information, by submitting a written request to the Privacy Officer at david@brokerbotics.ai. BrokerBotics may require you to verify your identity before responding and will respond within thirty (30) days of receipt, or such longer period as permitted by law. BrokerBotics may decline a request where permitted or required by law, in which case it will provide reasons. If you are not satisfied with BrokerBotics's response, you may file a complaint with the Office of the Privacy Commissioner of Canada. You may limit the information collected through the Meta Pixel by adjusting the advertising settings of your Meta account or by blocking third-party cookies in your browser.

The Services are intended for real estate professionals and are not directed to individuals under the age of eighteen (18). BrokerBotics does not knowingly collect personal information from individuals under the age of eighteen (18).

10. Changes to this Privacy Policy

BrokerBotics may amend this Privacy Policy from time to time. Amendments take effect when posted, as indicated by the "Last updated" date above. Where an amendment materially changes the manner in which BrokerBotics uses personal information previously collected, BrokerBotics will provide notice by email or by a notice on the website before the amendment takes effect. Your continued use of the Services after an amendment takes effect constitutes acceptance of the amended Privacy Policy.
